1. Introduction

This Privacy Policy ("Policy") explains how BIM DAO, the decentralized governance community supporting the BIM ecosystem ("BIM", "BIM Exchange", "we", "our", or "us"), handles information in connection with the BIM Exchange interface, available through bim.finance, exchange.bim.finance, and related interfaces and applications (collectively, the "Interface").

BIM Exchange is designed as a decentralized and non-custodial interface providing access to blockchain protocols, decentralized exchanges, bridges, staking solutions, bonding services, fiat on-ramp and off-ramp providers, and other third-party Web3 infrastructure.

BIM Exchange does not take custody of users' digital assets and does not hold private keys on behalf of users. Transactions initiated through the Interface are generally executed through users' own wallets and/or through independent third-party protocols and service providers.

By accessing or using the Interface, you acknowledge this Privacy Policy.

Where a third-party service is accessed through or integrated into BIM Exchange, that third party may process information under its own privacy policy, terms, compliance procedures, and legal obligations.

2. Decentralized Governance and Service Structure

BIM Exchange operates as part of the BIM DAO ecosystem.

BIM DAO provides decentralized governance over aspects of the BIM ecosystem, including protocol development, integrations, treasury decisions, partnerships, and other governance matters.

The Interface aggregates access to various independent blockchain protocols and third-party services.

Depending on the feature selected, users may interact with:

  • Decentralized exchanges and liquidity aggregators;
  • Cross-chain swap and bridge protocols;
  • Fiat on-ramp and off-ramp providers;
  • Staking and liquidity protocols;
  • Bonding platforms;
  • Lending and borrowing protocols;
  • Wallet providers;
  • Blockchain networks;
  • Other independent Web3 infrastructure providers.

These services may operate independently from BIM DAO and may apply their own privacy, compliance, AML, sanctions-screening, or KYC requirements.

BIM DAO does not control the operation, data practices, or regulatory obligations of independent third-party services.

3. Information We May Collect

BIM Exchange is designed according to a data-minimization approach.

We do not require users to create a traditional account simply to connect a compatible blockchain wallet and access decentralized features.

However, certain information may be processed when you interact with the Interface.

A. Information You Voluntarily Provide

We may receive information you voluntarily provide, including:

  • Name or pseudonym;
  • Email address;
  • Support requests;
  • Messages and feedback;
  • Governance forum submissions;
  • Information submitted when communicating with BIM contributors;
  • Any additional information you choose to provide.

B. Wallet and Blockchain Information

When you connect a wallet or interact with the Interface, we may process:

  • Public wallet addresses;
  • Blockchain network identifiers;
  • Transaction hashes;
  • Token addresses;
  • Transaction status;
  • Public balances;
  • Public blockchain activity associated with the connected wallet;
  • Information necessary to prepare or display blockchain transactions.

Wallet addresses and blockchain transaction information are inherently visible on public blockchain networks.

BIM Exchange does not require access to your wallet's private keys or seed phrase.

You should never provide your private key or seed phrase to BIM Exchange, BIM DAO contributors, support representatives, or any third party claiming to represent BIM.

C. Technical Information

When accessing the Interface, limited technical information may be automatically processed, such as:

  • IP address;
  • Browser type;
  • Device type;
  • Operating system;
  • Language settings;
  • Screen resolution;
  • Referring URLs;
  • Approximate geographic information derived from technical data;
  • Access timestamps;
  • Error and performance information.

Such information may be used for security, functionality, fraud prevention, infrastructure monitoring, and aggregated analytics.

D. Usage Information

We may process limited information regarding how users interact with the Interface, including:

  • Pages or features accessed;
  • Selected blockchain networks;
  • Interface interactions;
  • Aggregated transaction activity;
  • Performance metrics;
  • Session information.

Where possible, analytics information is aggregated or minimized.

4. Fiat On-Ramp and Off-Ramp Services

BIM Exchange may provide access to third-party fiat-to-crypto and crypto-to-fiat services through integrated partners and aggregators.

These services may include payment methods such as:

  • Visa and Mastercard;
  • Apple Pay;
  • Google Pay;
  • Bank transfers;
  • SEPA;
  • Faster Payments;
  • ACH;
  • PIX;
  • PayID;
  • iDEAL;
  • Revolut-supported payment methods;
  • Other local payment methods.

BIM Exchange does not itself process users' card payments, maintain users' payment accounts, or custody fiat funds as part of these third-party on-ramp and off-ramp transactions.

When a user selects a fiat purchase or sale service, the transaction may be processed by an independent regulated or specialized payment/on-ramp provider.

Depending on the provider, jurisdiction, transaction amount, and applicable compliance requirements, users may be required to provide information including:

  • Full name;
  • Residential address;
  • Date of birth;
  • Telephone number;
  • Email address;
  • Government-issued identification;
  • Payment card or banking information;
  • Proof of address;
  • Source-of-funds information;
  • Other AML/KYC information.

Such information is generally collected and processed directly by the relevant third-party provider rather than by BIM Exchange.

Users should review the privacy policy and terms of the selected provider before completing a transaction.

5. How We Use Information

To the extent information is processed by or on behalf of the Interface, it may be used to:

  • Operate and maintain BIM Exchange;
  • Display wallet and blockchain information;
  • Facilitate interaction with supported protocols;
  • Generate transaction parameters requested by users;
  • Improve functionality and user experience;
  • Detect technical problems;
  • Maintain infrastructure security;
  • Detect fraud, abuse, malicious activity, or prohibited activity;
  • Apply wallet or sanctions-screening measures where appropriate;
  • Respond to user inquiries;
  • Maintain governance and community infrastructure;
  • Produce aggregated usage analytics;
  • Comply with applicable legal obligations;
  • Protect users, contributors, the Interface, and the BIM ecosystem.

We do not sell personal information to advertisers.

6. Legal Bases Where Applicable

Depending on the jurisdiction and the nature of the processing, information may be processed on one or more of the following bases:

  • Performance of a service requested by the user;
  • Legitimate interests in maintaining, securing, and improving the Interface;
  • Compliance with applicable legal obligations;
  • Prevention of fraud, abuse, and security threats;

Where processing is based on consent, users may withdraw that consent where applicable.

7. Blockchain and Public Data

Blockchain networks are public distributed systems.

When you submit a transaction to a public blockchain, information associated with that transaction may become publicly visible, including:

  • Wallet addresses;
  • Token transfers;
  • Transaction amounts;
  • Smart contract interactions;
  • Transaction timestamps;
  • Transaction hashes.

Blockchain records may be replicated across a distributed network and may not be technically capable of being modified or removed by BIM DAO or the BIM Exchange Interface.

BIM DAO does not control public blockchain networks and cannot guarantee modification or deletion of information recorded directly on those networks.

Users should therefore avoid recording unnecessary personal information directly on-chain.

8. Third-Party Services and Protocols

BIM Exchange integrates or provides access to third-party infrastructure.

Depending on the functionality used, this may include:

  • Wallet providers;
  • Decentralized exchanges;
  • Liquidity aggregators;
  • Bridge and cross-chain routing providers;
  • Fiat on-ramp and off-ramp providers;
  • Bond platforms;
  • Staking protocols;
  • Lending and borrowing protocols;
  • RPC providers;
  • Blockchain explorers;
  • Analytics and security providers.

When using these services, information may be transmitted directly to the relevant provider.

Third parties may operate as independent data controllers or otherwise determine how information is processed under their respective privacy policies.

BIM DAO is not responsible for the privacy practices, security, availability, or compliance procedures of independent third-party services.

Users are encouraged to review the relevant provider's documentation before interacting with it.

9. KYC, AML and Compliance Screening

BIM Exchange itself does not generally require identity verification for ordinary non-custodial DeFi interactions.

However, some integrated services may be subject to:

  • Know Your Customer ("KYC") requirements;
  • Anti-Money Laundering ("AML") requirements;
  • Counter-Terrorist Financing ("CTF") requirements;
  • Sanctions screening;
  • Fraud prevention;
  • Transaction monitoring;
  • Jurisdictional restrictions.

A provider may request identity verification or additional documentation before processing a transaction.

These requirements are determined by the relevant provider and applicable laws and may vary by jurisdiction, transaction type, and transaction amount.

BIM Exchange cannot override a third-party provider's compliance requirements.

10. Cookies and Local Storage

A. Essential Technologies

The Interface may use cookies, browser storage, or similar technologies when necessary for:

  • Security;
  • Wallet connection preferences;
  • Network preferences;
  • Interface settings;
  • Session management;
  • Transaction state;
  • Technical functionality.

B. Analytics

BIM Exchange may use privacy-oriented or aggregated analytics to understand how the Interface is used and improve its performance.

Where applicable law requires consent for optional analytics technologies, such technologies should only be activated after the necessary consent has been obtained.

C. Third-Party Storage

Integrated applications may independently use cookies, local storage, or similar technologies.

Their use is governed by the relevant third party's privacy policies.

11. Information Sharing

We may share or make information available only when reasonably necessary for the operation of the Interface, including to:

Infrastructure and Service Providers

Providers supporting hosting, security, RPC infrastructure, analytics, communications, or other technical services.

Integrated Protocols

Information necessary to execute or prepare an interaction requested by the user may be transmitted to the relevant protocol or service.

Professional Advisors

Information may be disclosed to legal, technical, security, accounting, or compliance advisors where reasonably necessary.

Legal and Regulatory Requests

Information may be disclosed where required by applicable law, valid legal process, court order, or other legally binding obligation.

Security and Fraud Prevention

Information may be shared where reasonably necessary to investigate fraud, cyberattacks, sanctions risks, or threats to users or the Interface.

We may also use and disclose aggregated or anonymized information that does not reasonably identify an individual.

12. International Processing

BIM Exchange is a decentralized and globally accessible Web3 interface.

Infrastructure providers, contributors, protocols, and other third parties may operate from different jurisdictions.

As a result, information may be processed in countries other than the country in which a user is located.

Where data protection laws require specific safeguards for international transfers of personal information, applicable safeguards should be implemented by the relevant party responsible for that processing.

13. Data Retention

Information controlled through the BIM Exchange Interface is retained only for as long as reasonably necessary for:

  • The purpose for which it was collected;
  • Security and fraud prevention;
  • Technical operations;
  • Resolution of support requests;
  • Applicable legal or compliance requirements.

Retention periods may vary depending on the category of information.

Information recorded directly on public blockchains is outside the technical control of BIM Exchange and may remain available indefinitely as part of the relevant blockchain's history.

Third-party providers determine their own retention periods according to their respective privacy policies and legal obligations.

14. Data Security

Reasonable technical and organizational safeguards are used to protect information processed through infrastructure under the control of BIM Exchange.

These measures may include:

  • Access controls;
  • Infrastructure security measures;
  • Encryption where appropriate;
  • Monitoring and logging;
  • Secure development practices;
  • Wallet and transaction security measures;
  • Restricted administrative access.

However, no online service, blockchain protocol, smart contract, wallet, or communication system can guarantee absolute security.

Users remain responsible for protecting:

  • Private keys;
  • Seed phrases;
  • Wallet credentials;
  • Devices;
  • Passwords;
  • Two-factor authentication credentials.

15. Your Privacy Rights

Depending on applicable law and your jurisdiction, you may have rights regarding personal information processed under the control of BIM Exchange, including the right to:

  • Request access to personal information;
  • Request correction of inaccurate information;
  • Request deletion where legally and technically possible;
  • Request restriction of processing;
  • Object to certain processing;
  • Request portability of certain information;
  • Withdraw consent where processing is based on consent;

These rights are subject to applicable legal limitations.

BIM Exchange cannot modify or delete information independently recorded on public blockchain networks.

Requests relating to information collected directly by an independent third-party provider must generally be submitted to that provider.

16. Children and Minors

The Interface is not intended for individuals under 18 years of age.

BIM DAO does not knowingly seek to collect personal information from minors.

17. Geographic and Service Restrictions

Certain BIM Exchange features or integrated third-party services may not be available in all jurisdictions.

  • Technical restrictions;
  • Compliance requirements.

Users are responsible for determining whether their use of the Interface and any integrated protocol is permitted under the laws applicable to them.

18. Decentralized Governance

Certain decisions relating to BIM Exchange may be made through BIM DAO governance.

Governance activity may occur through public blockchain transactions, governance forums, Snapshot voting, or other decentralized governance systems.

Participation in governance may therefore generate publicly accessible information, including:

  • Wallet addresses;
  • Voting activity;
  • Governance proposals;
  • Forum posts;
  • Delegation activity.

Users should understand that blockchain governance activity may be publicly visible and persistent.

19. Changes to this Privacy Policy

This Privacy Policy may be updated periodically to reflect:

  • New BIM Exchange features;
  • New protocol integrations;
  • Changes to technical infrastructure;
  • Governance decisions;
  • Legal or regulatory developments;
  • Changes to data-processing practices.

The updated version will be published through the BIM Exchange or BIM ecosystem interfaces with a revised Last Updated date.

Material changes may also be communicated through appropriate BIM governance or community channels.

Continued use of the Interface after an updated Policy becomes effective constitutes acknowledgement of the updated Policy, subject to applicable law.
